Terms of Service

These Terms of Service ("Terms") govern your use of the NuPaaS platform operated by Type-Driven UG (haftungsbeschränkt), Germany ("we", "us"). By creating an account or using the service, you agree to be bound by these Terms.

1. The Service

NuPaaS is a multi-tenant deployment platform that lets you build, ship, and operate applications on infrastructure we manage on your behalf in the European Union. You are responsible for the content and conduct of any application you deploy through the service.

2. Your Account

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity that occurs under your account. You must be authorised to bind any organisation on whose behalf you sign up.

3. Acceptable Use

You may not use the service to violate any law, infringe third-party rights, send unsolicited bulk communications, attack other systems, or deploy malware. We may suspend access to protect the platform when we observe abusive behaviour.

4. Fees and Billing

Paid plans are billed per the pricing page in effect at the time of purchase. Payment is processed by Mollie B.V. (Netherlands). You can cancel a paid plan at any time; usage already incurred remains chargeable.

5. Your Data

You retain ownership of the data and code you deploy through the service. We process personal data on your behalf as described in our Privacy Policy, which forms part of these Terms.

6. Service Availability

We aim to keep the service available but do not guarantee uninterrupted operation. We may perform maintenance, upgrades, and emergency changes at our discretion.

7. Termination

You may delete your account at any time. We may suspend or terminate your access for material breach of these Terms or for non-payment. On termination we erase your account data per our retention policy in the Privacy Policy.

8. Liability

The service is provided "as is". To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of the service is limited to the fees you paid in the twelve months preceding the event giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Disputes will be resolved in the competent courts of Germany.

10. Changes

We may update these Terms when necessary. Material changes will be communicated to active customers by email. Continued use after the effective date of an update constitutes acceptance of the new Terms.
